Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern the access and use of the Trucksarthi platform, including:

• Mobile applications for fleet owners and for drivers (Android and iOS)
• Desktop web application
• Website
• Associated services, tools, APIs, and features

(collectively referred to as the “Platform”).

The Platform is owned and operated by:
Sarthitech Private Limited
WZ-101/51, Mohan Nagar, Pankha Road, South West Delhi, Delhi-110046, India.

By accessing or using the Platform, you agree to be legally bound by these Terms.
If you do not agree, you must discontinue use immediately.

2. Eligibility

The Platform is intended for:

• Transporters
• Logistics operators
• Truck owners
• Fleet managers
• Drivers working for a fleet owner who uses the Platform
• Individuals or businesses managing transportation operations.

Users must:

• Be at least 18 years old.
• Have authority to manage the business data entered into the Platform.

The Platform is not offered to anyone under 18. We do not knowingly create accounts for, or process the personal data of, children.

The primary account holder (“Owner”) is responsible for any authorised users accessing the Platform.

3. Account Responsibility

The Owner:

• Is solely responsible for all activities under their account.
• May allow authorised persons to use the account.
• Must ensure credentials remain secure.

Users agree not to:

• Share credentials irresponsibly.
• Allow unauthorised access.

4. Driver Accounts

Drivers may access the Platform through a separate login.
Driver access is limited to:

• Assigned trips
• Viewing funds received from owner
• Recording operational expenses
• Sharing their location with their fleet owner, if they choose to switch it on.

Drivers cannot access financial summaries, company accounts, or sensitive business information beyond permitted scope.

4.1 Location sharing

Location sharing in the driver app is off until the driver turns it on, and the driver can turn it off again at any time from the app’s Settings. While it is on, the driver’s location — including when the app is in the background — is visible to the fleet owner they are linked to, and to no one else. An Owner must not require a driver to keep location sharing on outside working hours, and must not present it to a driver as a condition of employment without telling them what it does.

5. Personal Data You Enter About Other People

Much of what an Owner puts into the Platform is personal data belonging to somebody else — drivers, clients, suppliers, vendors and their staff. This section is about that, and it matters under the Digital Personal Data Protection Act, 2023.

For this data:

• You are the Data Fiduciary and we are your Data Processor. It is your data about your people; we hold and process it on your instructions, to run the Platform for you.
• You confirm that you are entitled to enter it. You must have the consent of the person concerned, or another lawful basis, before you put their name, phone number, Aadhaar or licence details, photograph or documents into the Platform.
• You must tell them what you are doing. If a driver, client or supplier asks you what you hold about them, or asks you to correct or erase it, that request is yours to answer. We will help you do it.
• You will not use it for anything we have not provided it for. Contact lists imported into the Platform may be used to run your transport business, not for marketing to people who did not ask for it.

If a claim is made against us because personal data was entered into the Platform without a lawful basis, you agree to indemnify Sarthitech Private Limited against that claim.

A driver who registers on the driver app also has an account of their own. For that account — their login, their device, their location while sharing is on — we are the Data Fiduciary, and the driver deals with us directly.

6. Financial Data & Accuracy Disclaimer

The Platform provides tools to record and manage financial and operational information.
Users acknowledge:

• All data entered is user-provided.
• Users are solely responsible for correctness of financial records.

Sarthitech Private Limited is not liable for:

• Accounting errors
• Incorrect entries
• Financial losses arising from user-entered data.

The Platform is not accounting software, does not file GST or any other tax return, and gives no financial, legal or tax advice.

7. Document Upload & Verification

Users may upload documents including:

• Vehicle documents
• Identification documents
• GST/PAN information
• Bank details.

Users confirm:

• They have legal right to upload documents.
• Uploaded content is accurate and lawful.

The Platform may perform verification via third-party services; however:
Verification does not guarantee authenticity or legal validity.

8. Third-Party Services

The Platform integrates with third-party providers, including:

• Cashfree — PAN, GST and bank account verification, and payments made on our website
• Parivahan/Vahan APIs — vehicle information
• Zoho Zepto Mail — email OTP verification
• fast2sms.com — SMS OTP delivery
• Google Play and Apple App Store — subscription billing when you buy a plan inside the app
• Google Firebase — app analytics and crash reporting
• Sentry — error and crash diagnostics
• PostHog — product usage analytics (fleet owner app)
• Meta (Facebook and Instagram) — measuring how well our advertising works.

Which of these apply to you depends on the features you use and on your privacy choices; the detail is in our Privacy Policy.

Data received from third-party sources:

• May contain inaccuracies.
• Is provided without warranty.

Sarthitech Private Limited is not responsible for errors in third-party data.

9. Desktop Access & QR Login

Desktop login is enabled via QR authentication.
Users agree:

• They are responsible for securing active sessions.
• Any activity performed through authenticated sessions is considered authorised.

10. Plans, Billing and Refunds

The fleet owner app is offered with a free trial; the driver app is free. After the trial, continued use of the paid features requires a plan.

• Bought on our website: a one-time payment for a fixed term, with no automatic renewal. You choose whether to buy again.
• Bought inside the app: an auto-renewing subscription billed by Google Play or the Apple App Store. It renews until you cancel it, and cancellation is done in your Google or Apple account, not by us — we cannot cancel or refund a store subscription on your behalf.

Prices, taxes and any discount then running are shown on the pricing page at the time of purchase. Refunds are governed by our Refund and Plan Guarantee Rules.

When a plan ends, your data is not deleted. Access to paid features stops; your records stay in the account and become available again if you buy another plan, subject to section 13.

11. Acceptable Use

Users must not:

• Engage in fraud or illegal activity.
• Reverse engineer the Platform.
• Attempt unauthorised access to systems.
• Upload unlawful or harmful content.
• Enter another person’s personal data without a lawful basis for doing so (see section 5).

12. Account Suspension & Termination

Sarthitech Private Limited reserves the right to suspend or terminate accounts for:

• Misuse
• Fraudulent activity
• Illegal conduct
• Violation of these Terms
• Security risks or system abuse.

13. Data Retention & Deletion

You can delete your account from inside the app, at Settings › Delete account. You do not need to write to us to do it.

• Fleet owners: after you confirm, the account and everything in it are permanently deleted 72 hours later. You stay signed in for that whole time and the app shows you a countdown, so you can stop it at any point before it happens. Nothing is deleted until the 72 hours are up.
• Drivers: your login is deleted immediately when you confirm. There is nothing to wait for — deleting it removes your login and nothing else.
• The trips, ledgers and documents a fleet owner keeps about a driver belong to that owner’s account and are not deleted when the driver deletes their login. A driver who wants those removed should ask their fleet owner.

If an account is not used for one year — no login and no active plan — we mark it for deletion. Our team then reviews it and deletes it, along with everything in it. We do not send a reminder first, so if you want to keep an account, sign in at least once a year: signing in removes the mark straight away.

Two things survive deletion, and only these: records we are required by law to keep, such as invoices and tax records retained for the statutory period; and the minimum needed to show that the deletion happened.

14. Intellectual Property

All platform features, design, branding, and software are owned by Sarthitech Private Limited.
Users receive limited license to use the Platform.

Your data is yours. Nothing in these Terms gives us ownership of the records you enter.

15. Limitation of Liability

The Platform is provided “as is”.
Sarthitech Private Limited shall not be liable for:

• Loss of data
• Business interruption
• Financial loss
• Errors caused by user input or third-party services.

16. Grievance Officer

As required by the Information Technology Act, 2000 and the rules made under it, we have a Grievance Officer:

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India. The courts at Delhi, India have exclusive jurisdiction over any dispute arising from them.

18. Changes to Terms

Terms may be updated periodically.
Continued use indicates acceptance of updated terms. Where a change materially affects your rights, we will tell you in the app or by email before it takes effect.
